DESIGNATION OF BENEFICIARY

If you die prior to retirement, the death benefit will usually be payable to your Spouse.  However, if the Ontario Court Decision (see Booklet section 9 - Death Benefits Before Retirement) applies in your situation, the pre-retirement death benefit will be paid to the person you appoint as your beneficiary on your Member Information Card.  If you have not appointed a beneficiary in the "Beneficiary Designation" section of the Card, the pre-retirement death benefit will be paid to your estate. 

You may name any person you wish as your beneficiary, including your Spouse, or you may designate your estate, to receive any benefits due under the Plan in the event of your death before retirement.  However, if you have a Spouse, provided the Ontario Court Decision is not applicable in your situation, your Spouse will receive any benefits due under the Plan in the event of your death.  In the province of Ontario an Employee and the Spouse may waive this requirement in which case the Employee may name any person or his or her Estate to receive any benefits due under the Plan in the event of his or her death.

As a result of the recent election in Ontario, Bill 151 did not come into law.  Pre-retirement death benefits may not be payable to your spouse and may, instead, be payable to your designated beneficiary.  For that reason, we would recommend that you ensure that your beneficiary designation is up to date.
